Hi guys. Matt Clendenin here. We have a trial alert, Gus Shankar versus AllState insurance. Trial for a lawyer is game time. We spend hundreds of hours preparing a client's case and uh, this is where it all counts. This is where we get to present it to a jury and fight for what's fair. And especially in this case against Allstate, uh, they are denying the claim on bogus grounds. They're refusing to take care of an injured victim even though this is a rear end admitted liability crash. Essentially all state insurance is saying; yeah our bad, We know that we crashed into you. We caused the crash, but we're going to deny the case cause we don't think that you are hurt from the crash. So too bad, so sad. We don't want to pay you anything. This isn't no offer case from Allstate.

They have pushed us to trial. So, uh, some of the facts about this case, like I mentioned earlier, it's a rear end admitted liability case. Um, our client's pick up truck was totaled from the crash. Uh, ultimately our client required a hip labrum repair surgery. The Labrum is the tissue surrounding the hip socket that holds the hip bone in place. That was torn and the doctors had to sew that back together for our client. Our client also had a two level spine fusion. That's where the discs in between the vertebrae had been damaged and it's causing nerve pain and they actually have to go and they put a little spacer and then it fuses the bones together so that the nerves aren't hurt. Of course, the only problem with this is you now have a damaged spine the rest of your life. So there's going to be lifetime problems for the spine in our client, which is unfortunate.

And that's why we're here for justice. The total damages in this case are going to be 1.8 million. That's what we're going to be asking the jury for. There's $313,000 of past medical bills. Of course, because our client's spine is damaged and he is a manual labor, he's not going to be able to work as much and earn as much over the course of his lifetime. So we're going to be asking for around $284,000 in future loss of earnings and unfortunately he's going to need a lot of medical care. His doctors have said that even though the surgery was a success, he is going to need a future surgery which is going to cost about another quarter million dollars. And most of all, you know this, this case is really about family and it's about the ability to work and provide for your family. In this case, um, the plaintiff, his wife is disabled. She had a neck fusion that went poorly, uh, from a work injury and so she's fully disabled.

She tries to take care of the their three kids as best they can. They have a 17 year old Liliane, 13 year old Jonathan and a toddler, a three year old Anthony. The plaintiff is really providing for his household and the, the fear and the pain and the damage that it's done to his life. We're going to be asking the jury for $500,000 for the past going through the surgeries and then $500,000 for the rest of his life into the future. So that's, that's the basics of the case. Um, the main excuse that All State is making is that, you know, the crash didn't really cause any injury. They're going to hire their typical defense experts. These hired guns that make millions of dollars just coming in and saying whatever all state wants them to say. These experts are gonna say, we admit that mr Shankar had a torn hip labrum cause you can see it on the MRI and we admit that he has disc damage.

He has spine injuries. Just this crash didn't cause it, it must have been from something else. You know, it must've been from degeneration or maybe he had a preexisting problem. The whole problem with that is, is we asked mr Shankar, his primary care physician, who doesn't have a dog in this fight. You know, frankly, this primary care physician wants nothing to do with this lawsuit. But he testified that Gus has never had hip pain or back pain before this crash. So how are you going to say that? Coincidentally, he went from not having pain to having pain, and you're going to try to blame it on something else. So that's Allstate's primary defense. So we look forward to our trial coming up here to present this case to a jury.
